1. General Provisions
The Her-Medical-Aid GmbH (c/o Hubraum, Winterfeldtstraße 21, 10781 Berlin) operates the app “hermaid – Menopause Companion” (hereinafter referred to as the “App”).
By using the App, you, as the user, enter into an agreement with Her-Medical-Aid GmbH (hereinafter referred to as “hermaid”) regarding the use of the App.
The App serves as a digital companion for women during menopause.
Before using the App’s services, it is important that you familiarize yourself with our Terms of Use. These describe, among other things, the rights and obligations that apply to both you and us.
Furthermore, data protection is a very important aspect of using the App, as the security of your data is our top priority.
Please read the following Terms of Use as well as the explanations and statements on data protection carefully before using the App.

The App does not constitute or replace medical treatment or diagnosis.
In case of acute symptoms, please contact the emergency number 112 or a medical facility.
Users must be of legal age and have full legal capacity. Minors or persons with limited legal capacity are excluded from use.
The offering is intended for natural persons.

By using the App, you agree to these Terms of Use.
2. Registration and User Account
To use the App and the services offered through it, prior registration is required. Only fully legally competent and adult individuals are permitted to register.
If registration is carried out using a company email address with which hermaid has entered into an agreement (hereinafter referred to as the employer), hermaid may require verification of eligibility by means of a company-related email address or access codes (vouchers) issued by hermaid. No registration or usage data will be shared with the employer or any other institution.
All data requested during registration must be provided completely, accurately, and kept up to date. Any changes must be updated immediately by the user in their profile.
Users are required to treat their login credentials confidentially and to protect them from unauthorized access. Users bear sole responsibility for all actions carried out through their respective accounts.
hermaid reserves the right to conduct regular account reviews or authentication measures to ensure the integrity and security of the App.
Each person may maintain only one user account. The user relationship is strictly personal; transferring or inheriting an account is not permitted.
The App may only be used for the purposes defined in these Terms and Conditions. The following actions are strictly prohibited:

hermaid reserves the right to suspend or permanently delete accounts if a violation of these Terms occurs or if system security is at risk.
3. Technical Requirements
3.1 Platform Availability
The app is provided for mobile devices running the iOS and Android operating systems.
3.2 Further Development and Updates
hermaid is entitled to further develop the app technically and in terms of content at any time. This may include functional enhancements, adjustments, or modifications, as well as the release of updates. There is no obligation to provide specific updates or to permanently maintain certain functions. Any updates will be indicated within the app.
3.3 System Requirements
To ensure the security and stability of the app, it is regularly updated. As a result, the necessary technical conditions may change. Users are responsible for ensuring that their devices and systems meet the current requirements.
3.4 User Responsibility
The provision of a functional internet connection and the compatibility of the device used are the sole responsibility of the user. Any connection costs incurred (e.g., through mobile data usage) must be borne by the user.
4.Data Protection
4.1 Principle
hermaid processes personal data, including health data, exclusively in accordance with the provisions of the General Data Protection Regulation (GDPR) and the applicable national data protection laws.
4.2 Special Categories of Personal Data
Since the use of the app involves the processing of health data as defined in Article 9 of the GDPR, such processing is carried out solely on the basis of the user’s explicit consent or if another legal basis applies.
4.3 Consent
Consent for the processing of personal and health-related data is expressly obtained and recorded as part of the registration process. Without such consent, the use of the app is not possible.
4.4 Purpose Limitation
The collected data is used exclusively for the purpose of providing, improving, and securing the app as well as for fulfilling contractual obligations. Data is only disclosed to third parties if this is required by law or if the user has expressly consented.
4.5 Data Processing and Hosting
hermaid employs only carefully selected service providers as data processors in accordance with Article 28 of the GDPR for the operation of the app and data storage. These processors act solely on hermaid’s instructions and on the basis of appropriate contractual agreements. Storage generally takes place within the European Union or the European Economic Area (EU/EEA). If, in exceptional cases, data is processed outside the EU/EEA, hermaid ensures an adequate level of data protection through suitable safeguards in accordance with Articles 44 et seq. of the GDPR.
4.6 Security of Processing
hermaid implements appropriate technical and organizational measures in accordance with Article 32 of the GDPR to protect personal and, in particular, health-related data from loss, misuse, unauthorized access, and unlawful disclosure or alteration. This includes, in particular, the encrypted transmission of data and encrypted storage on servers within the EU/EEA.

Further information on the nature, scope, and purposes of data processing as well as on data subjects’ rights (e.g., access, rectification, erasure, restriction of processing, objection, and data portability) can be found in the current version of hermaid’s Privacy Policy. This policy forms part of these Terms of Use and is available at any time in the app and at www.hermaid.me/legal/datenschutz.
5.Rights and Obligations of Users
5.1 Rights of Users
Users are entitled to use the app and the functions provided within it in accordance with these Terms of Use.
They have access at all times to the personal and health-related data they have entered into the app and can view, correct, or update this data within the app.
5.2 Obligations of Users
The app may only be used for its intended purpose.
Users are obliged to refrain from any actions that could impair the functionality, security, or integrity of the app.
They must not upload or distribute any content that is unlawful, offensive, defamatory, discriminatory, obscene, or otherwise inappropriate.
Technical manipulation, interference, or attempts to gain unauthorized access to hermaid’s systems are strictly prohibited.
Login credentials must be kept confidential; users must prevent unauthorized third parties from accessing their accounts.

Further statutory and contractual rights of hermaid – in particular the right to extraordinary termination of the user agreement and to assert claims for damages – remain expressly reserved.
5.5 Liability of Users
Users are liable to hermaid for all damages resulting from culpable violations of these Terms of Use or applicable law. This includes, in particular, damages arising from misuse of the app, unauthorized disclosure of login credentials, or unlawful interference with the technical infrastructure.
6.Scope of Services
6.1 Range of Services
Depending on the type of license purchased, the hermaid app provides users with the following functions and services in particular:

Some services within the app, such as consultation appointments, are subject to a fee (“Premium Services”). The app’s basic functions can be used free of charge.
The costs for Premium Services are transparently displayed in the app and must be confirmed by the user before use.
If a contract exists between hermaid and the user’s employer, Premium Services may be billed via the employer.
Booking Consultation Appointments via the App:
By booking an appointment, the user expressly consents to the processing and storage of the health data necessary for the consultation. This data is shared with the attending physician in preparation for the appointment. The consent can be revoked at any time with effect for the future; any data processing carried out before the revocation remains lawful.
The contract for the online consultation is concluded upon booking the appointment and confirmation via email.
A prerequisite for booking is the completion of a medical history questionnaire. The collected health data is shared exclusively with the treating expert.
By booking and submitting the medical history form, the user and the expert enter into a treatment contract in accordance with the GDPR. By booking, the user accepts hermaid’s Terms and Conditions, which form part of the consultation contract.
The consent to process health data may be withdrawn at any time without affecting the lawfulness of prior processing.
6.3 Payment Terms and Third-Party Providers

If users wish to receive medical treatment (e.g., involving medication), hermaid may – where available – facilitate contact with cooperating physicians.
6.5 Quality and Availability
hermaid strives to provide high-quality and reliable services. However, uninterrupted availability cannot be guaranteed. Maintenance work, updates, or unforeseen technical issues may result in temporary service interruptions.
6.6 Changes to the Scope of Services
hermaid reserves the right to modify, expand, or discontinue the functions and services offered at any time, insofar as this serves to improve the app, adapt to technical developments, or enhance quality.
6.7 Medical Disclaimer
The app provides consultations by qualified professionals but does not replace in-person medical examinations, diagnoses, or treatments. Users are required to attend regular medical check-ups and to seek medical advice in case of illness.
7. Appointment Management, Rescheduling, and Cancellation of Consultations
Free cancellation: Appointments can be cancelled free of charge via the app up to 48 hours before the scheduled start time.
Rescheduling: Between 48 hours and 2 hours before the appointment, users can reschedule their appointment through the app.
Late cancellation or no-show: If cancellation occurs less than 2 hours before the appointment, or if the user does not attend the appointment, the full amount for the session will be charged. If the booking was made under a licensing agreement with an employer, the consultation entitlement will be forfeited.
Procedure: All cancellations or rescheduling must be carried out via the app; other forms of communication (e.g., email or phone) have no legal effect.
Scope: These rules apply exclusively to appointments booked via the web platform. Different regulations for other booking channels may apply separately.

Responses are generally provided within 24 hours on working days after the email has been received by hermaid. Service hours are Monday to Friday from 09:00 to 18:00.
Scope of services: Support responds to technical questions regarding the use of the app, its functions, appointment bookings, and administrative matters.
Limitations: Support does not provide medical advice or diagnoses. Medical questions must be discussed exclusively with qualified physicians or other medical professionals.
Processing times: hermaid strives to respond to inquiries promptly but assumes no liability for any delays in response times.
9. Disclaimer of Liability
9.1 Responsibility for Provided Content
hermaid makes every effort to review and regularly update the content of the app with due care. Nevertheless, hermaid assumes no guarantee for the completeness, accuracy, or timeliness of the information provided.
Medical information and recommendations within the app are intended for general informational purposes only and do not replace individual medical advice, diagnosis, or treatment.
The app may contain links to external third-party websites. hermaid has no influence over the content of such websites and accepts no liability for them. Responsibility for external content lies solely with the respective website operators.
9.2 Liability for Technical Issues
hermaid is not liable for any damages resulting from technical malfunctions, downtime, data loss, or other problems occurring during the use of the app. This includes, in particular, temporary interruptions in app availability due to maintenance work, updates, or force majeure.
9.3 Liability Regarding User Conduct
Users are liable for violations of these Terms of Use and applicable laws in accordance with section 5.5.
hermaid’s liability for contractual or other claims by users is limited to the following cases:
In all other cases, hermaid’s liability is excluded to the extent permitted by law.
The above limitations of liability apply equally to all corporate bodies, employees, and agents of hermaid and do not affect the statutory burden of proof.
10.Changes to the Terms of Use
hermaid reserves the right to amend these Terms of Use. Users will be informed in due time and have the right to object within six weeks. If no objection is raised within this period, the changes shall be deemed accepted.
11. Copyright
All content, information, images, databases, and computer programs published within the app are protected by copyright and are the property of the provider. Use of this content is permitted only within the scope of the intended use of the app. Any further use – including private or commercial reproduction, modification, distribution, or storage of information and data, in particular texts, text excerpts, images, or computer programs – requires the prior express written consent of the provider.
12.Widerrufsrecht
Sofern kostenpflichtige Leistungen angeboten werden, besteht ein gesetzliches Widerrufsrecht von 14 Tagen ab Vertragsschluss, welches im Rahmen des Buchungsprozesses in der App erläutert wird.
13.Final Provisions
If paid services are offered, a statutory right of withdrawal applies for a period of 14 days from the conclusion of the contract. The details of this right are explained during the booking process within the app.
14.Severability Clause
If any provision of these Terms is or becomes invalid, the remaining provisions shall remain in full force and effect. The parties agree to replace the invalid provision with a legally valid provision that most closely reflects the economic intent of the original.
